Imitrex Injury, Death Claim Time-Barred, Federal Judge Says
STATESVILLE, N.C. - The family of a woman who allegedly died from taking Imitrex migraine medication should have filed a claim after she suffered a heart attack, not after being diagnosed with congestive heart failure, a North Carolina federal court ruled Aug. 2 in granting summary judgment based on the state's three-year statute of limitations (Patricia Faulise, et al. v. SmithKline Beecham Corporation, et al., No. 05-200, W.D. N.C., Statesville Div.; 2006 U.S. Dist. LEXIS 57276; No. 06-1899, 4th Cir.).
